Rental terms and conditions
Last updated: 27 October 2026
These terms apply to every rental of equipment from D.V. Sound (David Verhoeven, Rue des Petits Marais 6, 7850 Enghien, company number 0507.947.329, VAT BE 0507.947.329), hereafter "D.V. Sound". The "customer" is the person or company that rents the equipment.
1. Scope
By sending a rental request or accepting a quote, the customer accepts these terms. They take precedence over the customer's own terms, unless D.V. Sound has agreed otherwise in writing. Specific agreements in a quote or confirmation take precedence over these terms.
2. Requests, quotes and confirmation
A request through the website is not yet a booking. The prices shown on the website are indicative. The rental is only final once D.V. Sound has confirmed it in writing (for example by email), with the equipment, the period, the price and the deposit.
D.V. Sound may replace equipment by equivalent equipment of the same or a better quality.
3. Prices and payment
Prices are in euro and include VAT, unless stated otherwise. Delivery, installation, extra pickup or return days and technical support are charged as stated in the confirmation.
Unless agreed otherwise, the rental price is paid at the latest when the equipment is picked up or delivered. Invoices are payable within the term stated on the invoice. Late payments of business customers bear interest and a compensation as provided by the Belgian law of 2 August 2002 on late payment in commercial transactions.
4. Deposit
For every rental the customer pays a deposit. The amount depends on the value of the rented equipment and is stated in the confirmation. The deposit is paid at the latest when the equipment is picked up or delivered, and the customer shows a valid identity card. Without the deposit, D.V. Sound may refuse to hand over the equipment, without refunding the rental price.
The deposit does not bear interest. D.V. Sound refunds it within 14 days after the equipment has been returned and checked. D.V. Sound may deduct from the deposit the costs of damage, missing parts, cleaning and late return, and any unpaid amounts. If these costs exceed the deposit, the customer pays the difference.
5. Pickup, delivery and return
The equipment is picked up and returned at the address of D.V. Sound, or delivered and collected at the address in the confirmation, on the agreed dates and times.
At pickup or delivery, the customer checks that the equipment is complete and works, and reports any defect immediately. Without remarks, the equipment is considered complete and in good condition.
The customer returns the equipment on time, complete, clean, dry and in its original cases and packaging, with all cables and accessories. Every day of late return is charged at the day price, without prejudice to further damages if D.V. Sound cannot deliver the equipment to another customer.
For delivery and installation, the customer ensures that the location is easily and safely accessible and that a suitable power supply is available. Waiting time caused by the customer may be charged.
6. Use of the equipment
The customer uses the equipment as a careful user, only for its normal purpose and according to the instructions of D.V. Sound and the manufacturer. In particular, the customer:
- has the equipment operated only by competent people;
- protects it against rain, moisture, dust, heat, overload and theft, and never leaves it unattended in a place accessible to the public;
- does not open, modify or repair the equipment, and does not remove labels or serial numbers;
- does not sublet, lend or move the equipment abroad without written permission;
- respects the legal sound level standards and obtains the permits and licences needed for the event (such as Unisono for music).
7. Damage, loss and theft
From pickup or delivery until the equipment is returned, the customer is responsible for it and liable for every damage, loss and theft, whatever the cause, except normal wear.
- The customer reports any damage, defect, loss or theft to D.V. Sound immediately, and stops using defective equipment.
- In case of theft or vandalism, the customer files a police report within 24 hours and sends a copy to D.V. Sound.
- Damaged equipment is repaired by or on behalf of D.V. Sound at the customer's expense. Equipment that is lost, stolen or cannot be repaired is charged at its replacement value (the price of equivalent new equipment).
- Missing cables, accessories, cases and covers are charged at their replacement value, and cleaning of dirty equipment at cost.
- The customer may also be charged for the rental income lost while the equipment is being repaired or replaced.
The customer is advised to insure the rented equipment and its own liability for the duration of the rental.
8. Liability of D.V. Sound
D.V. Sound delivers the equipment in good working order. If equipment fails during the rental without fault of the customer, D.V. Sound will replace it when possible or refund the rental price of that equipment for the days it could not be used.
The liability of D.V. Sound is limited to the rental price of the equipment concerned. D.V. Sound is not liable for indirect damage, such as lost profit, a cancelled or disturbed event, or claims of third parties, nor for damage caused by incorrect use. These limits do not apply to damage caused intentionally or by gross negligence, or to bodily injury.
The customer indemnifies D.V. Sound against claims of third parties caused by the use of the equipment during the rental.
9. Cancellation
The customer can cancel a confirmed rental in writing (for example by email). Cancellation is free up to 7 days before the start of the rental. After that, D.V. Sound may charge 50% of the rental price as compensation, unless the confirmation states otherwise.
Rentals for a specific date are leisure services in the sense of article VI.53, 12° of the Belgian Code of Economic Law, so consumers have no right of withdrawal.
If D.V. Sound cannot provide the equipment because of force majeure, it will propose equivalent equipment or refund the amounts already paid, without further compensation.
10. Privacy
D.V. Sound processes the customer's personal data as described in its privacy and cookie policy on this website.
11. Applicable law and disputes
These terms are governed by Belgian law. In case of a dispute, the parties first try to find an amicable solution. Otherwise, the courts of the place where D.V. Sound is established have jurisdiction, without prejudice to the mandatory rules that protect consumers.
If a provision of these terms is invalid, the other provisions remain in force.
